Information text regarding the processing of personal data of potential product/service buyers

In processing personal data, primarily to protect the fundamental rights and freedoms of individuals, including the privacy of private life, and to determine the obligations of real and legal persons processing personal data, we would like to inform you as Emlak Konut Gayrimenkul Yatırım Ortaklığı A.Ş. in our capacity as Data Controller in accordance with Article 10 of the Law on the Protection of Personal Data No. 6698 published in the Official Gazette dated April 7, 2016 and numbered 29677.

Data controller and representative

According to the Law, "Emlak Konut Gayrimenkul Yatırım Ortaklığı A.Ş." (hereinafter referred to as "Company" or "Emlak Konut") located at "Barbaros Mah. Mor Sümbül Sok. No:7/2 B (Batı Ataşehir) Ataşehir - İstanbul" is the Data Controller.

Your processed personal data

The following personal data is processed within the scope of your benefit from our products and services:

• Your Identity Information (identity data that can identify you, such as your name, surname, and T.C. identity number),
• Your Contact Information (your address, mobile phone number, email address, and other communication data),
• Visual and Audio Records
• Transaction Security (website navigation information, IP address, website login/logout information, password and credential information, etc.)
• Other Data (your account information and IBAN number declared in the Real Estate Request and Pre-Allocation Form; other personal data you have personally provided within the scope of surveys, suggestions, and complaints)

Purpose of processing personal data

Your personal data is processed in accordance with the basic principles regulated by the KVKK and relevant legislation, based on your explicit consent and/or other circumstances specified in Article 5/2 of the KVKK, in order to enable you to benefit from the services we provide as Emlak Konut. Considering the services provided by Emlak Konut, your personal data will be processed for the following purposes:

• Conducting marketing analysis studies,
• Conducting sales processes of goods/services,
• Visual and Audio Records
• Conducting marketing processes of products/services,
• Conducting advertising/campaign/promotion processes,
• Conducting customer relationship management processes,
• Conducting activities aimed at customer satisfaction,
• Tracking requests/complaints,
• Planning and executing sales and marketing activities specific to the customer (For our guests and customers who have given consent for commercial electronic communication; analyzing preferences, likes, and needs, and providing special promotions, opportunities, and benefits to guests/customers) in accordance with the personal data processing conditions and general principles specified in Articles 4, 5, and 6 of the Law No. 6698.

Method of collecting personal data and legal reason

Your personal data can be collected verbally, in writing, or electronically in accordance with the Law through channels such as Emlak Konut's websites, sales and marketing units, phone/call center conversations, real estate request and pre-allocation forms, and real estate sales promise contracts. We process your personal data based on one or more of the following legal reasons:

• Having your explicit consent (for the purpose of conducting advertising/promotion/marketing activities, commercial communication activities)
• Processing personal data of the parties to the contract is necessary for the establishment of the real estate sales promise contract,
• It is mandatory to fulfill a legal obligation (Law No. 5651 on the Regulation of Publications Made on the Internet and Combating Crimes Committed Through These Publications)
• Public disclosure of your personal data by you,
• Processing your personal data is necessary for our legitimate interests, provided that it does not harm your fundamental rights and freedoms.

Parties to whom processed personal data is transferred and purpose of transfer

Your personal data is processed by our company in accordance with the law and principles of integrity, accurately and, when necessary, updated, for specific, clear, and legitimate purposes, in connection with the purpose for which they are processed, limited and proportionate, and in accordance with the principles of retention for the period required by the relevant legislation or for the purpose for which they are processed. Your personal data processed based on your explicit consent will be retained for as long as you do not withdraw your consent. You can withdraw your consent at any time.

Rights of the relevant person whose personal data is processed

If the party to this Agreement is a real person, the Customer, if it is a legal entity, the authorized representatives of the Customer can use the following rights regarding their personal data by applying to Emlak Konut in accordance with the regulation in Article 11 of the Law No. 6698:

• Learn whether personal data is processed,
• Request information regarding personal data if it has been processed,
• Learn the purpose of processing personal data and whether they are used in accordance with their purpose,
• Know the third parties to whom personal data is transferred, domestically or abroad,
• Request correction of personal data if it is processed incompletely or inaccurately,
• Request deletion or destruction of personal data,
• Request notification of the operations carried out on personal data to third parties to whom personal data has been transferred in case of correction, deletion, or destruction of personal data,
• Object to the emergence of a result against the person by analyzing the processed data exclusively through automated systems,
• Request compensation for damages in case of damage due to unlawful processing of personal data.

The personal data we collect and process must be accurate and, when necessary, up to date in accordance with Article 4 of the Law No. 6698 on the Protection of Personal Data. Therefore, if there is any change in your personal data, you can notify us of your updated and accurate personal information using the methods specified below.

If you would like to contact us for your requests

In case of a written request;

• You can submit a wet-signed copy of the "KVKK Application Form" available on our website https://www.emlakkonut.com.tr/ along with an identity verification document in person, or you can apply on behalf of someone else with a notarized power of attorney showing that you are authorized to apply regarding the rights specified in Article 11, or send your application via notary to the address "Barbaros Mah. Mor Sümbül Sok. No:7/2 B (Batı Ataşehir) Ataşehir - İstanbul".

In case of an electronic request;

• You can sign the KVKK Application Form with a "secure electronic signature" defined in the Electronic Signature Law No. 5070 and send it to our Company's Registered Electronic Mail (KEP) address (emlakkonut@hs01.kep.tr), or you can send it to the email address "info@emlakkonut.com.tr" using the email address you previously provided to our Company and registered in our systems.

Your requests submitted to our Company will be answered in writing or electronically as soon as possible and no later than thirty days, depending on the nature of your request.
